Deposit of a Holographic Will

The deposit of a holographic will is a notarial procedure through which the testator lodges their personally handwritten will with the Notary’s Office for safekeeping. This process ensures, on the one hand, that the will will be delivered after the testator’s death and, on the other hand, that it is vested with a certain and legally established date, corresponding to a time when the testator was unquestionably alive. The procedure requires the proper identification of the testator, the delivery of a sealed envelope containing the holographic will, and the execution and signing of the relevant notarial deed.

Public Will before a Notary Public

A public will before a Notary Public is a notarial act whereby the testator declares their wishes, either orally or in writing, regarding the distribution of their estate. The will is formally drafted by the Notary Public with the assistance of either three witnesses or one witness and a second Notary Public, in full compliance with the applicable legal requirements.

Holographic Secret Will Before a Notary Public

The holographic secret will constitutes an intermediate form between a private and a public will and is primarily governed by Articles 1738–1748 of the Greek Civil Code. It is executed by the testator delivering, in the presence of three witnesses or one witness and a second Notary Public, a document in which the testator explicitly declares that it contains their last will.

The Notary Public makes the corresponding notation in accordance with Article 1742 of the Civil Code and drafts the relevant notarial deed, ensuring the legality and validity of the will.
